Terms of service
These terms govern your use of LogicBoostKit Media (the “service”), an HTTP API that processes media files with FFmpeg. The service is operated by Bacosca Iulian PFA (“we”, “us”, “our”), a sole trader established in Bucharest, Romania. LogicBoostKit is its brand. By creating an account or calling the API you agree to these terms. If you disagree with any part, do not use the service.
1. Who we are
- Bacosca Iulian PFA
- Trade Register no.: F40/4818/2022
- Sole registration code (CUI): 46937352
- Registered office: Str. Ion Câmpineanu nr. 24, Sector 1, Municipiul București, Romania
- Contact: contact [at] logicboostkit [dot] com
2. The service
The service runs the tasks you send to its API: FFmpeg processing and ffprobe analysis of files you upload or point to by URL. We are not affiliated with the FFmpeg project.
The documentation describes what the API does, including the options and filters it refuses.
3. Your account
You need an account to use the API. You must be at least 16 years old. If you use the service on behalf of an organisation, you confirm you are authorised to bind it, and “you” in these terms means that organisation.
API keys belong to the account. Anyone who holds a key can use the service at your cost, so keep keys secret and revoke any key you think has leaked. You are responsible for what is done with your keys and by the people in your account.
Keep the email address on your account current. We send invoices and notices about the service to it.
4. Prices and billing
The service is pay as you go. There are no plans, no minimum and no cap on usage or spend.
- The price is the rate on the Pricing page, in US dollars per GB-second, unless we have agreed another rate with you in writing. The Pricing page and the documentation describe how a request is measured.
- Charged: processing and probe requests that succeed. An asynchronous job is charged when it completes, even if its webhook can’t be delivered.
- Never charged: requests that fail, are rejected or rate-limited, time out or are cancelled, and file and directory calls.
- When: once a month, by charging the card on your account, and sooner whenever unbilled usage reaches USD 50. If we have agreed to bill you by invoice instead, the invoice states when it is due.
- Who sells: card purchases are made through Link, Stripe’s merchant-of-record service. Link is the seller of record: it charges your card, calculates and collects any VAT or sales tax, and sends your receipts and invoices. Your card statement shows LINK.COM, and Link’s own terms also apply to the purchase. If we have agreed to bill you by invoice instead, we are the seller and the invoice comes from us.
- Tax: prices are before tax. Any tax that applies is calculated by Link for card purchases and shown on the invoice.
You can also see your subscription at link.com. If you cancel it there, billing stops and the account needs a card again before it can call the API.
If we change the rate, we post the new rate on the Pricing page and tell account holders by email at least 14 days before it applies. A new rate applies only to usage after that date.
The Refunds page says what happens when a charge is wrong.
5. Account status
An account is in one of these states. In any state other than active, the API refuses new requests and says what to do.
- Needs card. An account can’t call the API until a card is added: a new account, or one whose subscription has ended. Nothing is charged until a request succeeds.
- Active. Your keys can call the API.
- Paused. If a payment fails, the account is paused: new requests are refused, and jobs already running finish. The account resumes when the open invoice is paid. If the invoice stays unpaid through the retries, the subscription ends: the account then also needs a card added again after the invoice is paid.
- Suspended. We may suspend an account that breaks these terms or the Acceptable use policy, that puts the service or other people at risk, or where the law requires it. We tell you why unless the law prevents it. Write to contact [at] logicboostkit [dot] com to resolve it.
- Closed. See the next section.
6. Closing your account
You can close your account at any time in the console. Closing revokes every key, deletes every file and directory, sends a final invoice for usage not yet billed, and deletes the sign-in of everyone in the account. It can’t be undone.
We may close an account that stays suspended, or whose invoices stay unpaid. Where we can, we write to you first.
7. Your files
You keep ownership of everything you send and everything the service makes from it. You give us only the permission needed to store and process those files in order to run the tasks you send. We don’t sell them or use them for any other purpose, and we delete them as the Privacy policy describes.
You confirm that you have the right to process the files you send, including files you point to by URL.
The service is not storage. A directory and its files are deleted when the directory expires: 24 hours after it is created unless you set another lifetime, and 7 days at most. Deleted files can’t be recovered. Keep your own copies.
8. Acceptable use
The Acceptable use policy is part of these terms.
9. Limits
To keep the service stable we limit the size of a file, the number of requests a key may send in a minute, the number of jobs an account runs at once, and how long a job may run. The current limits are on the Pricing page. They are not plans. We may change them, and the Pricing page will say so.
10. FFmpeg
The service runs FFmpeg and ffprobe, which are the work of the FFmpeg project and are licensed under the GNU General Public License. The build we run, and where its source can be had, are named at the foot of the home page. FFmpeg is a trademark of Fabrice Bellard, originator of the FFmpeg project.
What a task produces depends on FFmpeg and on the options you send. Check the results before you rely on them.
11. Availability and “as is”
The service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including as to uninterrupted availability or freedom from error. There is no service level agreement. We may change or discontinue any part of the service. Where a change takes away something you rely on, we give notice by email when we reasonably can.
12. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or other intangible losses, arising from your use of, or inability to use, the service.
To the same extent, our total liability for all claims arising from the service in any period of twelve months is limited to the amount paid for the service in that period.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable Romanian or EU law, including liability for death or personal injury caused by negligence, or for fraud.
13. Governing law and jurisdiction
These terms are governed by the laws of Romania and the European Union, without regard to conflict-of-law provisions. Any dispute arising under them will be brought exclusively in the courts of Bucharest, Romania. If you are a consumer, this does not deprive you of the protection of mandatory rules in your country of residence.
14. Changes
We may update these terms. Material changes will be posted here with a new date, and account holders will be told by email at least 14 days before they take effect.
15. Contact
